Avon and Somerset Police has announced it has passed a file on the investigation into an incident in Bristol involving Ben Stokes to the Crown Prosecution Service for advice on charging.
The England all-rounder was arrested on suspicion of causing actual bodily harm on September 25 and released without charge, pending further investigation. The England and Wales Cricket Board are set to conduct their own disciplinary enquiry once the police investigation is concluded.
The 26-year-old - who is suspended from playing for England by the ECB - is currently in New Zealand after flying to Christchurch to see his extended family.
Avon and Somerset Police said: "We are now in a position to provide an update on our investigation into a disorder in Bristol which happened during the early hours of Monday, September 25.
"A 27-year-old man suffered a fractured eye socket in the incident on Queens Road, Clifton.
"A 26-year-old man was arrested on suspicion of causing actual bodily harm and was later released under investigation.
"Three other men, aged 26, 27 and 28, have all voluntarily attended police stations for interview.
"Today (Wednesday, November 29) we have passed a file to the Crown Prosecution Service and are now seeking charging advice."
Stokes, who was born in New Zealand, said after landing in Christchurch that he was "just looking forward to seeing mum and dad".
England trail Australia 1-0 after a 10-wicket defeat in the first Test in Brisbane with the second Test scheduled to begin in Adelaide on Saturday.
